We believe your business is no one else's. Your privacy is important to you and to us. So we will protect the information your share with us. To protect your privacy, Esce-tex ™ complies to the General Data Protection Regulation (GDPR)

I. NOTICE - Data Collection & Data Processing

The personal data we collect at Esce-tex broadly falls into the following categories:

  1. WHEN VISITING OUR WEBSITE:

When using our website for information purposes only, i.e not registering an account with us or providing us with personal information, we will only collect the data that is transmitted to our server from your browser. (also known as “server log files”).  In order for us to be able to display our website to you, the following data is collected:

  • Our visited website

  • Date & time at the moment of access

  • The amount of data sent in bytes

  • Reference/ source from which you came to the page

  • Browser used

  • Operating system used

  • IP address used

The processing of the above data will solely be used in the legitimate interest in improving the functionality and stability of our website. The data will not in any way be passed on. We reserve the right to check the sever log files subsequently, if we find there are any concrete indications of illegal use.

2.CONTACTING ESCE-TEX™:

When contacting us via email or live chat, personal data will be collected. The data provided when contacting us i.e your email address will be stored and used for the sole purpose of responding to your request or establishing contact. After the final processing of your enquiry your data will be deleted if the facts in question have been clearly and finally classified, provided there are no legal storage obligations to the contrary.

3. OPENING AN ACCOUNT AND PROCESSING A CONTRACT:

When either opening an account or executing a contract with us your personal data will continue to be both collected and processed. The data that will be collected can be seen from the respective input forms for both of the above. It is possible for you to delete your account with us at any given time, this can be done simply by sending a message to the address of the data controller mentioned under INFORMATION ON THE COLLECTION OF PERSONAL DATA AND CONTACT DETAILS OF THE CONTROLLER. After your account has been deleted or after the complete processing of your contract your data will be permanently deleted or otherwise irreversibly anonymized. We will only keep your data if you have consented to the further use of your data which we will inform you on below.

4. ORDER HANDLING:

When processing your order, we work together with the following provider(s) who support us either wholly or partially in the execution of any concluded contracts. Certain personal data is transferred to these service providers in accordance with the following information

The personal data collected by us will then be passed on to the transport company for the purpose of processing the delivery of goods. We will pass on your payment data to the commissioned credit institution within the framework of payment processing, if this is necessary for payment handling. If payment service providers are used, we explicitly inform you of this below.

  • If delivery of goods takes place by the transport service provider DPD Group (Commercial Way, London NW10), we will pass on your e-mail address to DPD Group in accordance with Art. 6 (1) point a GDPR, prior to delivery of the goods, for the purpose of coordinating a date of delivery or of a notice about the shipment status, if you have given your express consent during the ordering process. Otherwise, only the name of the recipient and the delivery address will be passed on to DPD Group for the purpose of delivery in accordance with Art. 6 (1) point b GDPR. The data will only be passed on if this is necessary for the delivery of the goods. In this case, prior agreement of the delivery date with DPD Group or transmission of status information for shipment delivery is not possible. The consent can be revoked at any time with effect for the future either with the controller or with the transport service provider DPD Group or FEDEX.

  • If delivery of goods takes place by the transport service Royal Mail (100 Victoria Embankment, London, EC4Y 0HQ), we will pass on your e-mail address to Royal Mail in accordance with Art. 6 (1) point a GDPR, prior to delivery of the goods, for the purpose of coordinating a date of delivery or of a notice about the shipment status, if you have given your express consent during the ordering process. Otherwise, only the name of the recipient and the delivery address will be passed on to Royal Mail for the purpose of delivery in accordance with Art. 6 (1) point b GDPR. The data will only be passed on if this is necessary for the delivery of the goods. In this case, prior agreement of the delivery date with Royal Mail or transmission of status information for shipment delivery is not possible. The consent can be revoked at any time with effect for the future either with the controller or with the transport service provider Royal Mail.

  • STRIPE - If you decide to pay by credit card through the payment service provider Stripe (9th Floor 107 Cheapside London EC2V 6DN) payment is handled by Stripe to whom we pass on your information provided during the order process together with the information about your order in accordance with Art. 6 (1) point b GDPR. Your data will only be passed on for the purpose of payment processing with the payment service provider Stripe and only to the extent necessary. When selecting the payment methods "invoice purchase" via Stripe or "direct debit” via Stripe, you will be asked to enter your personal data (first and last name, street, house number, postcode, city, date of birth, e-mail address, telephone number, bank code and account number) during the order process. In order to safeguard our legitimate interest in determining the solvency of our customers, we transmit this data to Stripe (9th Floor 107 Cheapside London EC2V 6DN) ("Stripe") for the purpose of a credit assessment in accordance with Art. 6 (1) point f GDPR. On the basis of your personal data and other data (such as shopping cart, invoice amount, order history, payment experience), Stripe will check whether the payment option you have selected can be granted with regard to payment and/or default risks. In addition to internal Stripe criteria pursuant to Art. 6 (1) point f GDPR, identity and creditworthiness information from the following credit agencies may also be included in the decision within the scope of the application. Credit report can contain probability values (so-called score values). If score values are included in the result of the credit report, they are based on recognised scientific, mathematical-statistical methods. The calculation of the score values includes, but is not limited to, address data. You can object to this processing of your data at any time by sending a message to the controller responsible for data processing or to Stripe. However, Stripe may still be entitled to process your personal data if this is necessary for the contractual payment processing.

II. CLIENT'S RIGHTS

  1. WHAT RIGHTS DO YOU HAVE?

As a result of us collecting and processing your personal data, you have the following legal rights:

(i) to access personal data held about you;

(ii) to request us to make any changes to your personal data if it is inaccurate or incomplete.

(iii) to request your personal data is erased where we do not have a compelling reason to continue to process such data in certain circumstances; to receive your personal data provided to us as a data controller in a structured, commonly used and machine-readable format where our processing of the data is carried out by automated means and is based on: (i) your consent; (ii) our necessity for performance of a contract to which you are a party; or (iii) steps taken at your request prior to entering into a contract with us;

(iv) to object to, or restrict, our processing of your personal data in certain circumstances: (a) if we use your personal data for direct marketing, to ask us to stop and we will comply with your request; (b) if we use your personal data on the basis of having a legitimate interest,

(v) to object to our use of it for those purposes, giving an explanation of your particular situation, and we will consider your objection;

(vi) to object to, and not be subject to a decision which is based solely on, automated processing (including profiling), which produces legal effects or could significantly affect you; and

(vii) to lodge a complaint with a data protection supervisory body, which at present is the Information Commissioner’s Office.

2. DURATION OF STORYAGE OF PERSONAL DATA.

The duration of the storage of personal data is determined by the particular legal retention period (e.g., commercial and tax retention periods). After expiry of this period, the corresponding data will be routinely deleted, provided they are no longer necessary for the performance or initiation of the contract and/or there is no longer any legitimate interest on our part in the further storage.

III. WHAT WE DO WITH THE INFORMATION YOU SHARE

  1. USE OF YOUR DATA FOR ADVERTISING:

If you choose to subscribe to our e-mail newsletter, we will regularly send you information about our products, offers and news updates. The only compulsory information needed for sending the newsletter is your e-mail address. The indication of additional possible data is voluntary and is used to be able to address you personally. In order for you to receive the newsletter you will have needed to express your interest and confirm you agree to us sending you the newsletter. This is known as the double opt-in procedure, which means we will not send the newsletter to you unless you have agreed the above. A confirmation email will be sent to you asking you to confirm you wish to receive our newsletter by clicking on an activation link.

By activating the confirmation link, you as the data subject give consent for us to use your personal data. By registering for the newsletter, your IP addressed will be stored as well as the date and time of registration. This allows us to trace any possible misuse of your e-mail address at a later time. All the data collected when registering will solely be used for the purpose of direct advertisement to yourself via the newsletter.

You can unsubscribe from the newsletter at any given time by either the link which will be provided in the newsletter or by sending a message to the data controller who is mentioned above. Once the cancellation has been completed your e-mail will be deleted from our newsletter distribution list, unless you have specifically consented to further use of your data for any other reason.

1.1 USE OF YOUR DATA FOR ONLINE MARKETING

1.2. GOOGLE AdWords:

This website uses the online advertising program "Google AdWords" and the conversion tracking within the framework of Google AdWords, Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). We use the program of Google Adwords to draw attention to our attractive offers with the help of advertising materials (so-called Google Adwords) on external websites. We can determine, in relation to the advertising campaigns data, how successful the individual advertising measures is. We are interested in showing you advertisements that are of interest to you. We want to make our website more interesting for you and to achieve a fair calculation of advertising costs.

The conversion tracking cookie is set on a user’s browser, if he/she clicks on an AdWords ad delivered by Google. Cookies are small text files that are stored on your computer system. These cookies usually lose their validity after 30 days and are not used for personal identification. If the user visits a certain page of this website and if the cookie has not yet expired, Google and we will be able to recognize that the user clicked on the ad and was forwarded to this page. We try to respond to all legitimate requests within one month. Occasionally it may take us longer where your request is particularly complex, in such cases, we will keep you updated on timescales. Such requests will be responded to free of charge, but a small administration fee may apply where requests are excessive.

V. TOOLS AND MISCELLANEOUS

  1. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of England, without giving effect to any choice or conflict of law provision or rule. Any and all disputes in connection with this Agreement shall be brought exclusively in English courts.

  2. On our website we use reCAPTCHA function of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). This function is mainly used to differentiate whether an entry is made by an actual person and not misused by automatic bot and automated processing. The service includes the sending of the IP address and possibly other data required by Google for the reCAPTCHA service to Google and is carried out in agreement with Art. 6 (1) point GDPR on the basis of our legitimate interest in determining the individual willingness of actions on the Internet and avoiding misuse and spam.
